Atlanta, Georgia – On Thursday, state and national Republicans took action following a ruling from a Georgia judge that struck down several new election rules that were deemed controversial. These rules, passed by a board supported by former President Donald Trump, were viewed by many Democrats as potential sources of confusion in a state that has become an important battleground in elections.
Attorneys for the Republican National Committee (RNC) and the Georgia Republican Party moved quickly to appeal the decision made by Fulton County Superior Court Judge Thomas Cox. This direct appeal has been filed with the Georgia Supreme Court, which has the power to review certain election-related cases without waiting for lower courts to make a decision. However, the state Supreme Court has the option to deny this direct appeal.
The ruling by Judge Cox, issued on Wednesday, found that the new election rules introduced by the Georgia State Election Board were “illegal, unconstitutional, and void.” Among the rules that were struck down were proposals requiring county election officials to conduct a “reasonable inquiry” into the results of elections before certifying them. Another significant rule that was removed would have allowed officials to examine all election-related documents created during the election before certifying the results.
Furthermore, the judge also eliminated rules that aimed to have officials hand-count the number of ballots cast at each polling place on Election Day and expanded the access areas for poll watchers. RNC chairman Michael Whatley spoke out against the ruling, labeling it as an example of “judicial activism.” He expressed his concerns that by overturning the rules, the judge sided with Democrats who he claims are trying to undermine transparency and accountability in the election process.
In a statement, Whatley emphasized, “We have immediately appealed this egregious order to ensure commonsense rules are in place for the election – we will not let this stand.” His comments reflect a broader frustration among party leaders regarding what they perceive as an attack on their efforts to maintain election integrity.
